Blackwell proposes a medical stop-loss captive for cannabis employers

Blackwell Captive Solutions announced on 20 April 2026 that it is developing a homogeneous group medical stop-loss captive for cannabis operators and growers. The proposed pool is restricted to that sector and is intended to offer an alternative to traditional fully insured employee health plans.

The company describes planned availability in 24 states plus Washington, DC, where medical and recreational cannabis use are permitted, and another 16 states permitting medical use only. The announcement concerns a programme under development. It does not establish that every employer in those jurisdictions can already obtain coverage.

Separate access from suitability Sector-specific access is relevant when employers have had limited funding options. Nevertheless, eligibility for a programme and suitability for a particular workforce require separate consideration. Employers need to understand how their organisation’s circumstances will be assessed and what information is required for a proposal.

This editor recommends examining the benefit plan, administrative services and risk financing together. Employees experience provider access, claims handling and support; the employer must also understand the financial obligations behind those services. A different financing structure should be assessed against both sets of needs.

Examine the employer’s retained exposure The comparison should identify the claims the employer funds, the risk shared through the captive and the protection provided by stop-loss insurance. The contractual allocation matters more than a broad description of shared risk. Employers should ask how changes in membership or adverse claims affect their obligations.

They should also compare total costs using consistent assumptions. Administration, required contributions, service charges and possible future liabilities can affect the result. An apparently attractive initial price does not answer questions about longer-term affordability or an employer’s ability to absorb volatility.

Require evidence for performance claims The company’s statements about workforce characteristics and potential benefits remain attributed claims. They should not substitute for an employer’s own workforce and claims information or for independently assessed programme experience.

A useful assessment therefore begins with clear eligibility terms, a documented description of the funding arrangement and an explanation of employee services. The announcement is a development in access to health benefit financing for an underserved sector. Whether the proposed captive improves an individual employer’s position will depend on programme terms and the employer’s circumstances.
