In October 2026, California’s Department of Insurance issued Bulletin 2026-8 on separate-account products with general-account guarantees, including pension risk transfers. Dated 29 October, the bulletin adds filing, financial and disclosure requirements under existing statutory authority. It does not give blanket approval to every insurer or transfer arrangement.
For pension sponsors, the practical question is how the promised benefits are supported by the actual contract and participating organisations. A description of a separate account should begin the explanation.
Connect assurance with the underlying obligation
A due-diligence paper could distinguish the product’s regulatory position, the insurer’s financial evidence and the terms of its guarantee. Each should be assessed for what it establishes. The sponsor should ask advisers to identify unresolved questions without assuming that a favourable description removes the need for judgement.
Reinsurance should be examined as part of the structure supporting the obligation. The review could identify information rights and how a material change would return to the responsible decision-makers. Where a captive participates, INEDs should challenge whether its obligations and collateral arrangements fit its risk appetite.
Include the member service
A supported decision also needs an operational explanation. The sponsor could test how records and payment questions would move between the organisations involved, and whether a member can find the right route to resolution.
Competing proposals should be compared against the same obligation and population, with differences in the evidence visible to the body responsible for approval.
The useful output is a transaction-specific account of the evidence, assumptions and monitoring responsibilities. The California bulletin provides a current framework for specified products in that jurisdiction. It should not be exported as a universal requirement or treated as a substitute for local legal and actuarial assessment. Its value for benefits professionals is the discipline of connecting a promise with the arrangements intended to sustain it.
